We will provide you with two copies of your Enduring Power of Attorney (“EPA”), so that if one needs to be lodged with Landgate, or another body, your attorney(s) will have another copy that they can use. The unbound (stapled) copy that you receive should be lodged with Landgate if this is required.
As soon as your attorney(s) sign your EPA it can be used, and is a very powerful document, so it is very important that you keep it in a safe place.
You should ensure that your attorney(s) know where your Enduring Power of Attorney is kept.
You shouldn’t write on or otherwise mark the EPA, as this may invalidate it.
You should be mindful of your relationship with your attorney and if you have a falling out or you have reason to distrust your attorney you should give serious consideration to destroying all copies of the EPA, revoking it and making a new EPA in favour of a different attorney or attorneys.
